Terms of service
The terms for using this site and for our website plans, in plain English. Your proposal sets out your plan, price and any add-ons; these terms cover everything else.
About these terms
These terms are between you and Linn Studio Ltd (trading as LinnStudio), company no. SC900632, registered office Office 1769, 3 Fitzroy Place, 1/1, Sauchiehall Street, Glasgow, G3 7RH. "We" and "us" mean Linn Studio Ltd; "you" means the business that takes a plan.
Our plans are for businesses, including sole traders, not for personal use. Your proposal and these terms make up our agreement. If they ever disagree, the proposal wins.
Using this website
We keep this site accurate, but prices and descriptions can change. The Website Finder gives an estimate, not a quote: the final scope and price are confirmed in your proposal. The design, words and code of this site belong to us, so please don’t copy them.
Plans and what’s included
We offer three plans: Solo, Business and Business Plus. Each covers the design, words and build of your site, its hosting, security, backups and speed monitoring, and unlimited changes to your site after launch (see Changes after launch). Each month we also make one improvement to your site that you didn’t ask for, such as a speed fix, sharper copy or a new FAQ, and send you a short note on what we did and how your site is doing. What your plan includes is listed on our pricing section and in your proposal.
Business Plus is the Business site with three services we run for you each month: Google review requests, local SEO and the management of your Google Business Profile, and call tracking with a tracked phone number, with a monthly report on your calls and reviews. These services need access to your Google Business Profile and a list of customers to ask for reviews, which you give us in your Content Kit. They run while your plan is active and stop when it ends; your site follows the same rules as on any plan. We can’t promise a number of reviews, calls or a ranking: we promise to do the work.
Plans are paid monthly, with no build fee and no minimum term. If you’d rather own your site outright from the start, you can pay once for the build instead (see Paying once instead).
How a project runs
- Your kick-off call is free. If you go ahead, you pay your first month on the call, and your plan starts then (see Payments).
- You send us your Content Kit within 14 days of your kick-off call.
- We start work when you submit your Content Kit.
- Your first design arrives within 7 days of your content being complete: everything marked required in our Content Kit, in usable form. If it’s late, your next month is free.
- Before the build, you approve a Build Brief with the layout, colours and fonts.
- Revisions to the build are unlimited until launch, within the scope in your proposal.
- We launch once you approve the site and we have access to your domain.
- At launch, and for as long as your plan is active, your site scores 95 or more on Google PageSpeed for mobile (see Speed guarantee).
Timelines depend on content and feedback arriving from you. If a project stalls on your side, we’ll agree a new date with you.
Our guarantee
If you’re not happy with your site before it goes live, and we can’t put it right in revisions, we’ll refund everything you’ve paid us for it. You won’t owe anything more, and we won’t hand over the site or its files.
The guarantee applies when:
- you ask before you approve the site for launch;
- you’ve sent your Content Kit and given us feedback on at least one preview; and
- you ask within 14 days of your latest preview.
We refund you within 14 days of your request, to the account you paid from. Once you’ve approved the site for launch, the guarantee ends, and anything that isn’t right after that is covered by the change requests and support in your plan.
Speed guarantee
Your site scores 95 or more on Google PageSpeed for mobile at launch, and for as long as your plan is active. If it drops below that, we fix it free.
The guarantee covers everything we build, and the content you add through your editor. That includes images: we resize and convert them for you, so a large photo won’t slow your site down.
It doesn’t cover a drop caused by third-party code beyond what your plan includes, such as a live chat widget, a pop-up tool or another company’s tracking script, whether you add it or ask us to. If something you ask for would slow your site down, we’ll tell you before we add it.
Changes after launch
Your plan includes unlimited change requests after launch. A change request is a change to your site’s existing content or design, such as its text, images or prices, a new section, or a new page built from your site’s templates within your plan’s page limit. Send them to us by email, or through another channel we agree with you at launch.
We work on one request at a time, in the order we receive them. Simple requests, such as new text, a photo or a price, are usually done within minutes. We complete every request within 48 hours, counted from when we have everything we need, over working days (Monday to Friday, excluding Scottish public holidays). Then we start the next.
New features, new integrations and redesigns aren’t change requests. We quote for them separately, and always confirm the price before starting.
Fair use of change requests
Your change requests are there to keep your site accurate and up to date. To keep them fair for every client:
- One request is one change, or a set of closely related changes, such as updating a price list, swapping the photos in a gallery or changing your phone number everywhere it appears. Unrelated changes sent together are queued as separate requests.
- Bigger requests: if a request can’t be done well within 48 hours, such as rewriting several pages at once, we’ll tell you before we start, and either split it into several requests or quote for it.
- New pages count as change requests while they’re built from your site’s existing templates and stay within your plan’s page limit. Pages beyond the limit, or pages that need a new design, are quoted separately.
- We may turn down a request that would break the law, infringe someone else’s rights, or make your site noticeably slower or harder to use. If we do, we’ll explain why and suggest another way.
Payments
- Your plan is paid monthly, with no build fee. Your first month is paid on your kick-off call, which is when your plan starts. Each later payment is due on that same date every month.
- After your 12th payment, your monthly price carries on as before: it doesn’t drop when the site becomes yours.
- Founder prices: our first clients pay a founder price, shown on our pricing beside the standard price that later clients will pay. Your proposal sets out the price you pay.
- Changing plans: your new price applies from your next payment, and the payments you’ve already made still count toward the 12 that make the site yours. Moving from Business Plus to Business stops its monthly services from that payment.
- Add-ons and quoted work, such as a new feature or a redesign, are paid as set out in your proposal or quote.
If a payment is more than 14 days late, we may pause changes until it’s paid, and we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998.
Paying once instead
Instead of paying monthly on Solo or Business, you can pay once for the build of your site: £499 for Solo or £1,299 for Business ($679 or $1,779 in US dollars). Your proposal sets out when it’s due. The site is then yours from launch.
From launch, hosting and support cost £19 ($27) a month on either. That covers everything a monthly plan includes, such as hosting, security, backups, your change requests and the speed guarantee, except the improvement we make each month without being asked, which comes with the monthly plans only.
Business Plus is paid monthly only, since its services are work we do each month.
There’s no minimum term. If you stop hosting and support, we hand the site over as set out in When the site is yours. Before launch, our guarantee covers the build fee too.
Cancelling
Before launch, you’re also covered by our guarantee.
There’s no minimum term. You can cancel your plan at any time by emailing us, and it ends at the end of the month you’ve already paid for. We don’t refund part months.
If you cancel before your 12th monthly payment, you can pay the rest of your first 12 payments and take the site with you. Otherwise, we take the site down when your plan ends. Either way, your domain, and the content and photos you gave us, stay yours, and we’ll send your content back to you if you ask.
If you cancel after your 12th payment, the site is yours, and we hand it over as set out in When the site is yours.
On Business Plus, the review requests, local SEO and call tracking stop when your plan ends. Your Google Business Profile and the reviews on it are yours, and we remove our access to the profile.
We may end the agreement if you seriously break these terms, for example by not paying, and don’t put it right within 14 days of us asking.
Who owns what
- Your domain, and the content and photos you give us, are always yours.
- The site itself, meaning its design, its code and the words we write for it, becomes yours after your 12th monthly payment, or sooner if you pay the rest of your first 12, or at launch if you paid once for the build (see Paying once instead). Until then, you have the right to use it while your plan is active.
- Our tools: we build from our own library of code and design patterns. You get the right to use and change everything in your site; we keep the right to use the underlying library in other work.
- Third-party items, such as fonts, stock images or plugins, are used under their own licences.
When the site is yours
Once the site is yours, your plan carries on at the same monthly price, with hosting, security, backups and your change requests, until you cancel. If you paid once for the build, hosting and support carry on at their own monthly price instead.
We’ll transfer the site’s code repository (on GitHub) and its hosting (on Cloudflare) into your name whenever you ask, and we can keep looking after them while your plan continues. If you leave, we’ll also send you the site’s files with our handover guide, so you can host it anywhere. Taking your site with you is free. If anything we built doesn’t work as agreed in the first 30 days after launch, we fix it, wherever the site is hosted.
Hosting
We host sites on our Cloudflare account, with each site’s code in a private repository on our GitHub account, until they’re transferred to you (see When the site is yours). While your plan is active, hosting, security, backups and speed monitoring are included. We work to keep your site online and fix problems quickly, but we can’t guarantee uninterrupted service from any hosting provider.
Your responsibilities
- You have the rights to everything you send us, such as photos, logos, text and testimonials.
- Your content and your business’s claims are accurate and lawful.
- You give us timely access to your domain and the tools we need to connect.
- You keep your own copies of important business content.
Your website’s data
Your site may collect information from your visitors, for example through enquiry forms or bookings. For that information you are the controller and we are your processor. We will:
- only use it to host, run and support your site, on your instructions
- keep it confidential and secure
- only use sub-processors we trust (such as Cloudflare and GitHub) and remain responsible for them
- help you respond to requests from your visitors and tell you without undue delay about any breach
- delete or return it when our agreement ends
You’re responsible for your site’s privacy notice and for having a lawful basis to collect what your forms ask for. We provide a template privacy notice for your forms, which you check fits your business.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn’t allow us to limit.
Otherwise, we aren’t liable for indirect or consequential loss, or for lost profits, revenue, business or data. Our total liability under our agreement is limited to the amount you paid us in the 12 months before the claim.
Changes to these terms
We may update these terms and will change the date at the top when we do. Changes don’t affect a plan you’ve already agreed unless you accept them in writing.
Law and contact
These terms are governed by the law of Scotland, and the Scottish courts deal with any dispute. Questions? Email hello@linnstudio.co.uk.
